Welcome to Stencil Lab. By accessing or using our web application, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our service.

1. Definitions

"Service" refers to Stencil Lab's web application, software, and related services
"You" / "User" refers to the individual or entity using our Service
"Content" refers to images, stencil files, and other materials uploaded or generated through our Service
"Account" refers to your registered user profile
"We" / "Us" / "Stencil Lab" refers to the operators of this Service

2. Account Registration

2.1 Eligibility

You must be at least 16 years old to create an account. By registering, you represent that:

You meet the age requirement
All information you provide is accurate and current
You will maintain the accuracy of your information
You have the legal capacity to enter into binding contracts

2.2 Account Security

You are responsible for:

Maintaining the confidentiality of your password
All activities that occur under your account
Notifying us immediately of any unauthorized use
Ensuring your account is not shared with others

3. Subscription Plans

Stencil Lab offers three subscription tiers:

3.1 FREE Plan ($0)

Up to 5 layers per stencil
PNG exports only
Basic editing tools
Personal use only

3.2 PRO Plan ($9/month)

Unlimited layers
All export formats (SVG, DXF, PDF, PNG)
Advanced bridge tools
Priority customer support
Personal use only

3.3 LIFETIME Plan ($249 one-time)

All PRO features
Lifetime access (no recurring fees)
Commercial license (sell stencils created with Stencil Lab)
Lifetime updates
Early access to new features

4. Billing and Payments

4.1 Payment Processing

Payments are processed securely through Stripe. We do not store your full credit card information.

4.2 Automatic Renewal (PRO Plan)

PRO subscriptions automatically renew each month unless canceled. You will receive:

Email notification 7 days before renewal
Renewal amount and date clearly stated
Instructions for cancellation

4.3 Price Changes

We may change subscription prices with 30 days' advance notice via email. Price changes do not affect existing subscriptions until renewal.

4.4 Taxes

Prices do not include applicable sales tax, VAT, or GST. Taxes will be calculated and added at checkout based on your location.

4.5 Cancellation

You may cancel your PRO subscription at any time:

Important:

Cancellation takes effect at the end of your current billing period
You retain PRO access until the paid period expires
No refunds for partial months (see our Refund Policy)
You will not be charged again after cancellation

4.6 Refunds

Refund eligibility:

PRO Plan: 30-day money-back guarantee (first month only)
LIFETIME Plan: 60-day money-back guarantee

5. Acceptable Use Policy

You agree NOT to:

5.1 Prohibited Content

Upload content that violates copyright, trademark, or other intellectual property rights
Upload illegal, harmful, threatening, abusive, or obscene content
Upload content depicting minors in inappropriate contexts
Upload content promoting violence, hate speech, or discrimination

5.2 Prohibited Activities

Reverse engineer, decompile, or disassemble our software
Use automated tools (bots, scrapers) without written permission
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Service
Resell or redistribute our Service without a commercial license
Create multiple accounts to exploit free trials or refund policies

5.3 Commercial Use Restrictions

FREE and PRO Plans: Personal use only (cannot sell stencils)
LIFETIME Plan: Includes commercial license (can sell stencils)

6. Intellectual Property Rights

6.1 Your Content Ownership

You retain full ownership of:

Images you upload to Stencil Lab
Stencil files generated from your images
All derivative works created using our Service

6.2 License to Us

By uploading content, you grant us a limited, non-exclusive license to:

Process your images to generate stencils
Store your files on our servers
Display thumbnails in your account dashboard

We do NOT:

Claim ownership of your content
Use your content for marketing without permission
Share your content with third parties (except service providers like Supabase for storage)

6.3 Our Intellectual Property

Stencil Lab's software, algorithms, branding, and UI design are our proprietary property. You may not copy, modify, or redistribute them.

6.4 User Responsibility for Copyright

You represent that you have the necessary rights to upload and process any content through our Service. You agree to indemnify us against any claims arising from your uploaded content.

7. DMCA Copyright Policy

If you believe content on Stencil Lab infringes your copyright, send a DMCA takedown notice to support@stencillab.ai including:

Your contact information
Description of the copyrighted work
URL or location of the infringing material
Statement of good faith belief
Statement of accuracy under penalty of perjury
Your physical or electronic signature

We will investigate and remove infringing content within 72 hours.

8. Service Availability

8.1 Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance.

8.2 Feature Changes

We reserve the right to:

Add, modify, or discontinue features
Impose usage limits (file size, processing time)
Temporarily suspend the Service for maintenance

8.3 Data Backups

While we perform regular backups, you are responsible for maintaining your own backups of important content. We are not liable for data loss.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

Accuracy of stencil generation results
Fitness for a particular purpose
Non-infringement of third-party rights
Compatibility with specific cutting machines or printers

You use the Service at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Our total liability is limited to the amount you paid in the last 12 months or $100, whichever is greater
We are NOT liable for indirect, incidental, consequential, or punitive damages
We are NOT liable for loss of profits, data, business opportunities, or goodwill

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

Your violation of these Terms
Your uploaded content (copyright infringement, illegal material)
Your use of generated stencils for commercial purposes without a commercial license

12. Termination

12.1 By You

You may delete your account at any time through Settings → Account → Delete Account.

12.2 By Us

We may suspend or terminate your account immediately if:

You violate these Terms
You engage in fraudulent or abusive behavior
Your payment method is declined
Required by law or court order

12.3 Effect of Termination

Your access to the Service will cease
Your uploaded content may be deleted after 30 days
No refunds for terminated accounts due to Terms violations

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles.

13.2 Informal Resolution

Before filing a legal claim, you agree to attempt informal resolution by emailing support@stencillab.ai with:

Description of the dispute
Your desired resolution

We will respond within 30 days with a proposed solution.

13.3 Binding Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in London, United Kingdom, rather than in court. Arbitration is conducted by a neutral arbitrator and is final and binding.

13.4 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action lawsuit.

13.5 Opt-Out of Arbitration

You may opt-out of arbitration by emailing support@stencillab.ai within 30 days of account creation with "Arbitration Opt-Out" in the subject line.

14. Export Control

You agree to comply with applicable export laws and regulations. You may not use the Service if you are located in a country subject to trade restrictions.

15. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your data.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via:

Email notification (30 days before effective date)
Prominent notice on our website

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

18. Entire Agreement

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Stencil Lab.
